Let’s talk about trusts. They can seem intimidating, but they are incredibly useful tools. Can you explain why someone might choose a trust over a simple will?

Absolutely. While a will dictates how your assets are distributed after your passing, it goes through the probate process, which can be time-consuming and public. A trust, on the other hand, allows you to transfer ownership of your assets into the trust during your lifetime. This means those assets avoid probate altogether.

Consequently, a trust offers several advantages: privacy as the details are not part of public record, potential savings on estate taxes and probate fees, and control over how and when your beneficiaries receive their inheritance.

You mentioned different types of trusts. Could you elaborate on one type in particular?

Let’s discuss Revocable Living Trusts. This is the most common type I create for clients. It gives individuals flexibility during their lifetime. The grantor, the person creating the trust, can manage and change the terms of the trust while they are alive.

Moreover, a Revocable Living Trust avoids probate upon the grantor’s death. The assets within the trust pass directly to the designated beneficiaries according to the grantor’s wishes. This can save time and money for your loved ones during an already difficult period.

Ordinarily, I advise clients to consider updating their Revocable Living Trust every few years or when there are significant life changes, such as marriage, divorce, birth of a child, or the passing of a beneficiary.

Have you ever encountered any challenges with setting up or administering Revocable Living Trusts?

I recall one instance where a client had created a handwritten document they believed was a valid trust. Unfortunately, it lacked the necessary legal formalities to be enforceable. We had to work diligently with the family to reconstruct their intentions and ensure their wishes were carried out.

This experience underscored the importance of working with an experienced attorney when establishing a trust. A seemingly small error can have significant consequences down the line.
