Choosing the right person is paramount. Accordingly, it should be someone trustworthy, organized, and capable of making sound decisions during a potentially stressful time. Moreover, they need to understand your wishes and have the time and willingness to fulfill this important role.
It’s often wise to discuss this decision with potential candidates beforehand, ensuring they are comfortable taking on the responsibility. You may also want to name a successor executor or trustee in case your first choice is unable or unwilling to serve.
I recall one instance where a client named their brother as executor, assuming it was a straightforward task. Unfortunately, the brother lacked experience with financial matters and struggled to manage the estate efficiently. This led to delays and increased costs, highlighting the importance of careful consideration when making this selection.
Conversely, I’ve witnessed situations where clients chose professionals as executors, such as accountants or attorneys. This can be a prudent choice if your estate is complex, requiring specialized knowledge.
