“Certainly,” Steve begins. “The best type of trust depends on individual circumstances and goals. For example, a revocable living trust is a popular choice because it allows individuals to maintain control over their assets during their lifetime while avoiding probate upon death. Conversely, an irrevocable trust offers greater asset protection but relinquishes control to the trustee.”
He continues, “A testamentary trust, created through a will, comes into effect after death and is often used for minor children or beneficiaries with special needs. Special needs trusts are specifically designed to provide for individuals with disabilities without jeopardizing their eligibility for government benefits. And let’s not forget charitable trusts, which allow individuals to support their favorite causes while enjoying tax advantages.”

Steve, probate can be a complex and time-consuming process. Can you shed some light on the role that trusts play in simplifying this?
“Absolutely,” Steve says. “Probate is the legal process of validating a will and distributing assets to heirs. Trusts, particularly revocable living trusts, can bypass probate altogether. This means that assets held within the trust are distributed directly to beneficiaries according to the grantor’s wishes, saving time, money, and stress for loved ones during an already difficult time.”
He adds, “In California, roughly 60% of estates go through probate,” referencing a study by the California Bar Association. “Utilizing a trust can significantly reduce this percentage, allowing families to focus on grieving and healing rather than navigating complex legal procedures.”
