“Marshaling estate assets is a fundamental step in probate,” Steve explains. “It involves identifying and taking inventory of all the deceased person’s assets, including bank accounts, real estate, investments, personal property, and any other valuables. This meticulous process ensures that all assets are accounted for and properly distributed according to the will or state law.”
He continues, “We then prepare a formal Inventory and Appraisal document (Forms DE-160/161) that lists each asset, its estimated value, and its location. This document is filed with the court as part of the probate process.”
Consequently, accurate marshaling of assets is crucial for several reasons. First, it prevents any assets from being overlooked or mismanaged. Second, it provides transparency to all parties involved in the probate process, including heirs and creditors.
Notwithstanding its importance, I’ve encountered situations where the marshaling process presented challenges. For example, there was a case where locating all the deceased person’s assets proved difficult because they had multiple bank accounts spread across different institutions and hadn’t kept meticulous records. It required extensive research and communication with various financial entities.
I vividly recall another instance involving a family heirloom of significant sentimental value but uncertain monetary worth. Determining its fair market value for inclusion in the estate inventory required consulting with specialized appraisers, adding complexity to the process.
