What are some common misconceptions about guardianships?
Ted: I often hear people assume that guardianship automatically means taking away someone’s freedom. That’s not always the case! The goal is to find a balance between support and autonomy.

Because guardianship can significantly restrict a person’s autonomy and decision-making rights, it is generally considered a measure of last resort. Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
