Could you Elaborate on The Process of Establishing a Conservatorship?
Ted walks us through the steps: “It starts with filing a petition in court. Everyone involved, including the proposed conservatee and family members, gets notified. Then, an investigator or social worker looks into the situation independently. A medical or psychological evaluation is crucial to assess the individual’s capacity. Finally, a judge reviews all the information and makes the decision about whether a conservatorship is necessary.”

“Being a conservator is a big responsibility,” Ted emphasizes. “They act as fiduciaries, meaning they always have to put the conservatee’s best interests first. Regular reporting to the court on finances and the conservatee’s well-being is essential. The court provides ongoing oversight, ensuring everything is handled ethically and transparently.”
“One common issue I encounter,” Ted shares, “is when family members disagree about who should be the conservator. It can get emotionally charged. Once, I had a case where siblings were at odds over their elderly mother’s care.
