Ted Cook: Beatrice, the pleasure is all mine. San Diego truly is spectacular. Lately, we’ve been focusing quite a bit on adaptable irrevocable trusts. People are realizing the traditional irrevocable trust, while powerful, can sometimes be… rigid. Life happens, and needs change. These trusts allow for a degree of flexibility while still achieving the core goals of asset protection and tax planning.
What exactly *is* an adaptable irrevocable trust?
Ted Cook: That’s a great question. A traditional irrevocable trust, once established, is very difficult to modify. That’s by design—it’s what provides much of the asset protection. However, what if a beneficiary has a sudden medical crisis? Or a significant life change? An adaptable irrevocable trust incorporates mechanisms—often through a trust protector role—that allow for certain amendments without completely invalidating the trust. These mechanisms can be carefully crafted to achieve a balance between flexibility and continued asset protection.
Let’s talk about that balance. It sounds tricky.
Ted Cook: It absolutely requires careful drafting. The key is to define the scope of the trust protector’s powers very precisely. What types of changes can they make? Under what circumstances? There are several techniques we use. One common approach is to allow the trust protector to remove and replace trustees, which can indirectly influence the trust’s administration. Another is to allow for modest distributions beyond what’s originally stipulated, perhaps to address an unforeseen emergency.
Can you walk us through the Estate Planning Process?
Ted Cook: Certainly! It’s a multi-faceted process, and we approach it systematically. Here’s a breakdown:
- A. Identify Your Goals and Priorities: Determining what’s most important to you – protecting family, minimizing taxes, avoiding probate, etc.
- B. Gather and Organize Personal and Financial Information: We need a clear picture of your assets, liabilities, and beneficiaries.
- C. Choose Key People to Carry Out Your Wishes: This includes selecting an executor, guardian, power of attorney, and healthcare agent.
- D. Create Core Estate Planning Documents: Drafting wills, trusts, powers of attorney, and healthcare directives.
- E. Fund the Trust (if Applicable): Transferring assets into the trust’s ownership.
- F. Communicate Your Plan: Ensuring your chosen individuals understand their roles and have access to necessary information.
- G. Review and Update Your Plan Regularly: Life changes necessitate adjustments to your estate plan.
- H. Organize and Store Your Documents: Keeping everything secure and accessible is crucial.
We typically begin with ‘A’ – understanding your goals. It’s not just about transferring assets; it’s about achieving your long-term vision for your family and legacy. Ted Cook: Absolutely. One common issue is overly broad trust protector powers. We once had a client whose trust protector was given almost unlimited discretion to amend the trust. It created a lot of conflict among the beneficiaries. They feared the trust protector would act in their own self-interest rather than the best interests of the family. We had to mediate a resolution and ultimately amend the trust to clarify the scope of the protector’s authority. “It highlighted the importance of precise drafting and a clear understanding of the potential consequences.”
Another challenge is navigating the tax implications. Adaptable trusts can sometimes trigger unintended tax consequences if not structured correctly. You need an attorney who understands both estate planning and tax law. We’ve seen situations where clients inadvertently created taxable gifts by exercising certain amendment powers. Proper planning is essential to avoid these pitfalls.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
