A common challenge I see is individuals forgetting to transfer assets into the trust after its creation. Consequently, those assets remain outside the trust’s protection and may be subject to probate. I recall working with a client whose mother had established a revocable living trust but neglected to add her bank accounts. When she passed away, those accounts had to go through probate, causing unnecessary delays and expenses for her heirs.
Another potential hurdle is ensuring that the successor trustee is aware of their responsibilities and has all the necessary information to manage the trust assets effectively. Open communication and clear instructions are crucial for a smooth transition.
